Welcome to Chum Media (the “Site,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of this website and any content, booking tools, consultations, and services offered on or through it (together, the “Services”). By using the Site, booking a call, or contacting us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
You must be at least 18 years old, or at least 16 and using the Services with the consent and involvement of a parent or legal guardian. By using the Services you confirm that you meet these requirements and that any information you provide is accurate.
Chum Media is the personal brand and creative studio of a content creator offering, among other things, social media consulting, website design and development, and educational content. The Site also links to Nexa Voice Solutions, a separate offering with its own website and terms (see Section 9). Any paid engagement is defined by a separate written proposal, quote, or agreement between you and us; these Terms govern your use of the website itself.
Consultations and “strategy calls” are scheduled through our third-party booking provider, Calendly. When you book, you agree to provide accurate contact details and to attend the appointment you reserve. By booking and providing your contact information, you consent to receive appointment-related emails and, if you provide a phone number, text and/or call reminders about your appointment. Message and data rates may apply. You may opt out of text reminders at any time by replying STOP or by adjusting your notification preferences in your booking confirmation; opting out may affect our ability to remind you of upcoming appointments.
The content on this Site and the information shared during any call or consultation is provided for general informational and educational purposes only. Unless we have signed a separate written agreement expressly stating otherwise:
Earnings & results disclaimer. Any figures, statistics, view counts, follower numbers, revenue amounts, or other results described anywhere on this Site (for example, references to views generated or income earned) reflect personal or individual results and are not typical. They are shared for illustration only and are not a promise or guarantee that you, or anyone else, will achieve the same or similar outcomes.
Results in social media, marketing, and business depend on many factors outside our control — including your own effort, niche, audience, timing, consistency, and market conditions. We make no guarantee of any specific result, and you accept full responsibility for your own outcomes and decisions.
Any testimonials or success stories reflect the real experiences of specific individuals. They are individual results, are not necessarily typical, and should not be understood as a guarantee that you will achieve comparable outcomes.
All content on this Site — including text, graphics, logos, video, images, and the design and arrangement of the Site — is owned by Chum Media or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view the Site for your own personal, non-commercial use.
Without our prior written permission, you may not copy, reproduce, republish, sell, or create derivative works from our content; use our name, brand, or logo in a way that implies endorsement; scrape or harvest the Site; or use our content to train any machine-learning or AI model.
If you send us messages, materials, or other content (for example, through a booking form or email), you retain ownership of it but grant us a non-exclusive, royalty-free license to use and process it as needed to respond to you and provide the Services. You confirm you have the rights to anything you submit and that it does not violate any law or third-party right.
You agree not to use the Services for any unlawful, fraudulent, harmful, or abusive purpose; to harass, defame, or impersonate anyone; to upload malicious code; to attempt unauthorized access to our systems; or to interfere with the Site through scraping, bots, or automated booking abuse.
The Site relies on and links to third parties — including our booking provider (Calendly), social platforms (such as TikTok, YouTube, and wikiHow), and Nexa Voice Solutions. We do not control these third parties and are not responsible for their content, availability, terms, or privacy practices. Nexa Voice Solutions is a separate offering governed by its own terms and privacy policy; your use of it is between you and that service. Links do not imply our endorsement of, or responsibility for, any third party.
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or that any content is accurate, complete, or current. No advice or information, whether oral or written, obtained from us or through the Services creates any warranty not expressly stated in these Terms.
You acknowledge that transmission of information over the Internet is never completely secure, and that your use of the Services — including any third-party platform linked from or embedded in the Site — is entirely at your own risk in that respect. We are not responsible for outages, errors, or losses caused by third-party services we do not operate.
To the fullest extent permitted by law: (a) Chum Media, its officers, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunity, or goodwill, arising out of or relating to the Services, regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if advised of the possibility of such damages; and (b) our total aggregate liability for all claims arising out of or relating to the Services will not exceed the lesser of (i) the total fees you actually paid us for the specific engagement giving rise to the claim in the three (3) months before the claim arose, or (ii) US $100.
These limitations are a fundamental basis of the bargain between you and us and apply even if any remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in that case, our liability will be limited to the minimum extent permitted by law.
You agree to defend, indemnify, and hold harmless Chum Media and its officers, employees, contractors, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; (d) any content or information you submit to us; or (e) any business, financial, marketing, or other decision you make in connection with, or in reliance on, the Services. This obligation will survive the termination of your use of the Services and is in addition to, not in place of, any other remedy available to us.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Before filing any claim, you agree to contact us at chumsquared44@gmail.com and attempt to resolve the matter informally for at least 30 days.
Except for (i) claims that qualify for small-claims court, and (ii) claims by either party for injunctive or other equitable relief to protect intellectual property, confidential information, or prevent unauthorized use of the Services (which may be brought in a court of competent jurisdiction), any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration. You and we each waive the right to a jury trial and to bring or participate in any class, collective, or representative action. Any claim must be brought within one (1) year of when it arose, or it is permanently barred. To the extent any dispute is not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Michigan, and you waive any objection to that venue.
Entire agreement. These Terms, together with our Privacy Policy and any separate written agreement between you and us for a specific engagement, constitute the entire agreement between you and Chum Media regarding the Site and Services, and supersede any prior or contemporaneous understanding, whether oral or written.
Severability. If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.
Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice or your consent.
Force majeure. We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, internet or telecommunications failures, third-party service outages, labor disputes, or governmental action.
Electronic communications. By using the Services, you consent to receive communications from us electronically, including by email and, where applicable, text message related to your booking. You agree that any notice, agreement, or other communication we provide electronically satisfies any legal requirement that such communication be in writing.
No third-party beneficiaries. These Terms do not create any rights for any third party.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
We may update these Terms from time to time, at our sole discretion and without prior notice. The “Last updated” date reflects the latest version. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms; if you do not agree to a revision, your only remedy is to stop using the Services.

When you book a call or contact us, we collect information such as your name, email address, phone number (if you provide it), scheduling preferences and time zone, and anything you choose to include in a message or booking form.
When you visit the Site, we and our providers may automatically collect your IP address, browser and device type, pages viewed, and interaction data, using cookies and similar technologies (see Section 3).
We may receive limited information from the providers we use to operate the Services, such as our booking provider, in order to schedule and manage your appointment.
Cookies are small files placed on your device that help a website function and understand how it is used. We (and the third parties embedded on the Site) may use:

We share personal information only with service providers who help us operate the Services, each of which processes only what is needed for its function:
We may also disclose information to comply with law or a valid legal request, to protect our rights or safety, or in connection with a business transfer. This Policy does not cover Nexa Voice Solutions or any other third-party site we link to — those have their own privacy policies.
We keep personal information only for as long as reasonably necessary for the purposes described in this Policy, to comply with our legal and contractual obligations, to resolve disputes, and to enforce our agreements, after which it is securely deleted, destroyed, or anonymized. Retention periods vary depending on the type of information and the purpose for which it was collected; you may request more information, or request deletion, by contacting us as described in Section 9.
We use commercially reasonable administrative and technical safeguards to protect your information. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot and do not guarantee absolute security. You provide information to us at your own risk. We are not responsible for the security practices of, or any breach occurring on, third-party platforms or services we do not operate (including our booking, hosting, and email providers), which maintain their own independent security programs.
Please do not send us Social Security numbers, government identification numbers, payment card or bank account numbers, health information, or other sensitive personal information through the Site’s contact or booking forms. We do not request this information and are not responsible for any such information you choose to submit.
Depending on where you live, you may have the right to access, correct, or delete your information, to opt out of marketing, to opt out of the sale or sharing of personal information (note: we do not sell or share), and to withdraw consent. California residents have these rights under the CCPA/CPRA, and EU/UK residents have them under the GDPR/UK GDPR, including the right to lodge a complaint with a supervisory authority. For your protection, we may take reasonable steps to verify your identity before fulfilling a request, and we may decline a request as permitted by applicable law — for example, where fulfilling it would be fraudulent, would violate another person’s rights, or is not required by law. We will respond within the time required by applicable law.
Some browsers offer a “Do Not Track” signal. There is currently no accepted industry standard for how to respond to such signals, and we do not currently respond to them. You can still manage cookies directly through your browser settings as described in Section 3.
The Services are not directed to children under 13, and we do not knowingly collect their personal information. If you believe a child has provided us information, contact us and we will delete it.
The Site links to third-party sites and platforms (such as TikTok, YouTube, wikiHow, and Nexa Voice Solutions). We are not responsible for their content, security, or privacy practices; please review their own policies before providing them any information.
If you access the Services from outside the United States, your information will be processed in the United States, which may have different data-protection laws than your country. By using the Services, you understand that your information will be transferred to and processed in the United States as described in this Policy.
We may update this Policy from time to time, at our sole discretion. The “Last updated” date shows the latest version, and your continued use of the Services after changes are posted means you accept the update.
